VILLEGAS AREVALO, Sandra Consuelo. Harmonizing the rights of minors, victims of recruitment, and their participation in international crimes. Rev. Cient. Gen. José María Córdova [online]. 2021, vol.19, n.34, pp.378-405. Epub 01-Abr-2021. ISSN 1900-6586. https://doi.org/10.21830/19006586.739.
The situation of minors, victims of illegal recruitment, and their potential participation in the commission of international crimes opens an interesting debate on the procedural routes to be followed after their extrication. A tension exists between the rights of such crimes' victims, which the State must investigate, prosecute, and punish, and the rights that, as a minor, are inherent to the extricated minor. This article compiles a legal investigation on the need for a systematic and harmonious interpretation that materializes the principle of victim centrality within the transitional justice model with a restorative approach to open a procedural course that guarantees the rights of both the victims of international crimes and minors as victims of recruitment.
