The human rights of indigenous peoples are an issue that is still being debated in Mexico. This work seeks to identify and describe the regulatory human rights framework of these communities in an attempt to understand why these rights have not been sufficiently developed and engaged. For these purposes, the author used the analog hermeneutical method, proposed by Mauricio Beuchot, to assess the human rights issues facing the indigenous peoples in Mexico. The result revealed that first generation human rights are fully guaranteed for these peoples. However, although the 2001 amendments to the Constitution of Mexico, which sought to address some ancient problems regarding the relationship of indigenous peoples with the Mexican government, made progress in some areas, in others, there remains ambiguity regarding some basic rights.
