One of the main social rights is the right to education, whose standards, compliance and current liabilities are part of public agendas, differing on the approaches and priorities of intervening actors reflected in education policies and budget assignment. Even if Mexico has tried to respond to such social demand, the fulfillment of the right to education has gradually been diluting over the years, something which becomes evident when reviewing the recent educational reforms that are far from being a real solution to a problem that results in educational disadvantage in rural regions and communities. In this article we show the relationship between the state and the right to education and its limited observance, focusing on the main points of the recent education reform and contrasting the composition of political and educational programs supported by budgetary allocation formulas which prove to be insufficient to reach a solution to a structural problem in Mexico.
