The article aims to reflect on the role of the words 'nisi restituent in the edictal clause referred to by Ulpiano in 14 ad ed. D. 4.9.1pr., with which the praetor promised to grant of an actio de recepto. More specifically, the article investigates, also on the basis of other sources (including, in particular, Ulp. 14 ad ed. D. 4.9.3.5 and Ed. Theod. 119), whether the formula of the actio de recepto contained a restitution clause and, if so, what could have been the implications of such a presence, both from the perspective of the entrepreneur and from that of the customer.
