The objective of this review article is to study how the Colombian State has dealt with the problem of illegal drugs, focusing attention on marijuana, that is, to analyze public policies related to criminalization or care, distinguishing two approaches, the first as a security problem, accompanied by the criminalization of consumption, and the second, seen as a public health problem that requires medical and social attention. For this purpose, a qualitative methodology was used, where the technique of documentary analysis of specialized literature, regulations and jurisprudence was employed. Among the conclusions we can highlight the international influence for the adoption of measures, specifically from the United States, the European Union and international organizations, as well as punitive populism, as a method of justification and argumentation of the public policy approach, leaving aside empirical evidence and historical experience.
