Abstract
VILLA GUARDIOLA, Vera Judith and HURTADO PENA, Arturo. The legal protection of reconstituted families or assembled in postmodernity. Justicia [online]. 2021, vol.26, n.40, pp.82-97. Epub Feb 24, 2022. ISSN 0124-7441. https://doi.org/10.17081/just.26.40.5111.
This article displays a proposal for the socio-legal protection of all families categorized as assembled that are born in Mexico, carried out as a product of a propositional study verified in the Mexican context, developed by the authors Villa and Hurtado, in which the method was used analytical proposition with the revision of the 32 civil and family codifications of the federative entities that make up the Mexican State, all contrasted under the holistic paradigm of interpretation. As a result of the research that precedes this article, the social and legal implications that the emergence of this family configuration generates at the socio-affective and legal level, with the consequent state of legal defenselessness in the face of its legislative omission, are noted. In conclusion, that the constitutional recognition of the families under study is necessary, as well as the complex essence of the family relationships that concern, so that the civil and family ordinances of the 32 states are adjusted to thus grant the required protection and comply with the signed international conventions.
