Abstract

CALVETE LEON, Ivanna; ARIAS RAMIREZ, María Fernanda; CARMONA MOLINA, Valentina  and  VELEZ RESTREPO, Daniela. Evolution of the Fundamental Right to Ethno-Education in Colombia. Ágora U.S.B. [online]. 2025, vol.25, n.2, pp.657-680.  Epub Apr 01, 2025. ISSN 1657-8031.  https://doi.org/10.21500/16578031.7482.

This article proposes an analysis of the development of regulations regarding ethno-education in Colombia as a mechanism for protecting the autonomy of ethnic communities in the country. Therefore, this article reviews international regulations and legal parameters to analyze the legal development of the right to ethno-education, and from there, to establish how this right has been addressed, its recognition as a fundamental right, and the jurisprudential development it has had since the Constitutional Court rulings as a guarantee of the rights of indigenous groups. Subsequently, it is presented as a guarantee of rights for communities of Black people, Afro-Colombians, Palenqueros, and Raizales, by addressing the question of how to protect cultural diversity in light of the multicultural and multi-ethnic principle enshrined in the 1991 Political Constitution.

Keywords : Ethno-Education; Fundamental Rights; Ethnic Communities; Constitutional Law; Jurisprudence.
