Abstract
ORDELIN-FONT, Jorge Luis. THE MANAGEMENT CONTRACT OF REPRESENTATIVES OF PERFORMING ARTISTS AND MUSIC PLAYERS. AN STUDY FROM THE CUBAN LEGAL SYSTEM. Vniversitas [online]. 2015, n.131, pp.391-432. ISSN 0041-9060. https://doi.org/10.11144/Javeriana.vjl31.cgra.
The creation of voluntary representation finds its cause in the underlying purpose of the management relationship. Its realization in the field of music performance is configured through the management contract established between the artist and the representative; a contractual figure where the particularities of the legal framework of voluntary representation and the protection of artists, performers, and players converge. The management contract of music player representatives is a contract by which the representative agrees to render cooperation services on behalf of the artist, vital for the circulation of the performance or play, as a cultural product. These are activities the artist cannot and does not want to carry out, as he is immersed in the creative process. This is an atypical, consensual, bilateral -given its onerous character- contract, although there are no obstacles for the contract to be free, with a long term. It is also based on principles of exclusivity, mutual trust, and reciprocal loyalty.
