The article seeks to show the typically hierarchical organization of the officials in charge of administering criminal justice in the Governorship of Popayán toward the end of the Colonial period. It was common for the powers of said officials to combine judicial, fiscal, and government functions, which suggests the lack of an institution exclusively responsible for the administration of criminal justice. The paper also focuses on the construction of the criminal on the basis of the economic and utilitarian discourse of the authorities of the Spanish Crown, which fostered a criminal praxis that rarely coincided with the provisions regarding criminality in the Laws of the Indies.
