The article examines the establishment of trial by jury for press offenses in the context of the rise of the Colombian State. On the basis of a political institutional perspective, it analyzes the factors that defined the practice of trial by jury as the juridical theory of the period, and determined discussions on legislation and legal dynamics. The issue of trial by jury is interesting for the historiography of justice in Colombia insofar as it promoted citizen participation, made possible a form of administration of justice other than the law of the State, and, as an alternative to the judiciary code system, was much more consistent with a diverse society that sometimes rejected codification.
