Abstract

The article explores the codes, rules, and procedures currently used by Colombian guerrillas to impose the death penalty. It inquires into the similarities and differences between the -FARC- and -ELN-, as well as other guerrillas, regarding the definition of crimes deserving the death penalty, in order show that those definitions are determined by criteria, values, and views on disciplinary control and the need to ensure the survival of the armed structures. At the same time, the study explores the trial process by means of the so-called "revolutionary courts-martial" or "revolutionary trials", and explains the procedure, the defense mechanisms, the controls aimed at ensuring compliance with the rules, the inconsistencies, and the limitations of those trials.
