Abstract

A descriptive, type series of cases study was done, on injuries of peripheral nerves caused as a result of invasive medical interventions, in 29 cases studied by the scientific division, from demands to health professionals, affiliated to «FEPASDE (Especial solidarity fund for the assistance of lawsuits)» between years 1999 to 2005. Information was compiled on the type of procedure, more frequently nerve damaged , related factors, sequels or evidence of medical errors and others aspects of interest for FEPASDE in relation to the risk of the different specialties in the probatory aspects from lawful the processes. The results showed a greater frequency of demands against the anesthesiologist and the frequent indetermination of the exact cause of the damage, combined with a low evidence of faults of attention or medical errors. Additionally, the non-existence of adequate information to the patient stood out as probatory weakness in the defense of the professionals. The results allows to orient towards which colombian jurisprudence has mentioned for these cases. In many cases, responsibility of the health professional is difficult to establish because there is no evidence of faults in the standard of care and of the true cause of damage.
