Abstract

CASTELLANOS RESTREPO, Juan Camilo  and  GOMEZ BETANCUR, Milany Andrea. The development as law. A historical perspective of its international juridical consecration. Rev. Fac. Derecho Cienc. Polit. - Univ. Pontif. Bolivar. [online]. 2014, vol.44, n.121, pp.503-526. ISSN 0120-3886.

In a first stage, it is perform a count of the theories on development that arose in the 20th century with the aim of showing that there were two stages in its conception and that several contextual phenomena demarcated the juridical instruments allowing such a process, until it became a latent need that it enshrined as a right. In a second stage, it is shown that this consecration has not been fully recognized and, therefore, it is questioned its effectiveness and leaves some open questions toward the possibility of seeking guarantees for human rights protection in Colombian domestic legal order related with current development conceptions and its practices.
