Abstract

This text is intended to make a reflection on the two sides in which is usually located the constitutional interpretation. On the one hand, its importance related in relation to the defense of the Constitution and fundamental rights; on the other hand, its tensions and potential abuses to which, sometimes, it is subjected. The article proposes that it is possible to carry out a defense of constitutional interpretation on the basis of two conditions: the incorporation of the rational justification theory and the demand--which is of moral kind - of expecting justice of its operators. This last point means not to evade the issue of the temper (or character) that constitutional judges should be required when they take on their responsibility.
