Abstract

The central idea of this article is to analyze impacts on the environment generated by exploration and exploitation of oil and gas at sea, examine the legal environmental instruments not only preventive but also compensatory available to prevent this pollution and the environmental regulation of this activity in Argentine Republic. The most important findings explain that Argentine Republic does not have appropriate environmental regulation concerning the issue as mandated by the Argentine Constitution. Moreover, neither bilateral nor regional agreements with the neighbor countries have been negotiated. Conclusions indicate that in the country a law of basic environmental requirements on hydrocarbon extraction shall be enacted, and it shall include exploration and exploitation of oil and gas at sea, apart from conventional and shale gas exploration and exploitation.
