Since the time of the conquest, Afro-descendant communities and indigenous peoples were objectified and stripped of their rights. In effect, until the Constitution of 1886 they were considered "non-persons", but with the advent of the constitutional process, in 1991, these ethnic groups are recognized as subjects of special protection. Therefore, the intention is to reflect on the advances in the recognition of ethnic rights in the 1991 Constitution, from a transversal and multidisciplinary perspective, integrating into the study the political legal context that the Colombian State went through with the proliferation of the armed conflict. Epistemologically, the study is based on postcolonial studies to support how, despite constitutional, race, and poverty advances these intertwine to explain one of the consequences that have been ingrained since the conquest.
