Informed dissent is a legal manifestation of opposition to any type of therapy or application of health technology which, on many occasions, is evaded or eluded by health agents, producing a breach in the rights of patients. The objective of this work is to show that health dissent is a fundamental right, which must be protected and respected both by the State and by individuals. To address both the problem and the main objective, the descriptive method will be used, through a review of the state of art, taking as a common thread the national and international legal instruments that have been developing this figure to later establish the considerations that it has designed the Constitutional court in this regard based on the political letter of 1991. From the findings, the conclusion will be reached that informed dissent is a fundamental right that finds its foundations in human dignity, the autonomy of the will, the free development of personality, personal integrity, health, and life among others.
