This paper tries to show the nature of the determinatio. The classical iusnaturalism is conceived of as one of the ways to derive human law from natural law, especially as the mode of derivation from positive law or simply legal law. Although Aquinas and the Scholastics refiect on this issue, they don't specify the procedure nor method of determination. As a result, further study of the way to create justice and law is pertinent.
