Abstract

HOFFE, Otfried. TRANSCENDENTAL EXCHANGE: A MODEL TO LEGITIMIZE HUMAN RIGHTS?. Univ. philos. [online]. 2011, vol.28, n.57, pp.15-36. ISSN 0120-5323.

In view of the difficulty in achieving an appropriate model to legitimize human rights, this remains an unfinished task of contemporary philosophy. This article proposes a model of consensual legitimacy, which is called transcendental exchange. The conceptual basis of this exchange is constituted by the idea of an intercultural discourse and the impossibility to give up the protection of certain interests essential to the existence. Given their importance, these interests are called transcendental interests.

Keywords : human rights; anthropology; transcendental exchange; transcendental interest; consensual legitimation.
