The objective of this article is to answer the research question: What are the conditions upon which the foundations of the rights can be established? and particularly, is it possible to speak about a right called "digital inclusion"? Thus, the main objective will be to understand the importance of the creation of foundations for the theory of rights. The methodology applied here is from the perspective of language uses, having as axis the analytic philosophy with a significant influence of the legal argumentation theory, especially Alexy's version. Therefore, it is primarily descriptive and only some prescriptive elements are expressed. The main conclusion of the investigation proves the possibility of determining the existence of new rights, especially the right of digital inclusion.
