Abstract

CORREA FERNANDEZ, Marlon de Jesús  and  TEJEDA MORA, Maira Alexandra. Due Process of Law in Colombia and Its Impact on the Length of Legal Proceedings. Prolegómenos [online]. 2021, vol.24, n.48, pp.41-52.  Epub Dec 31, 2021. ISSN 0121-182X.  https://doi.org/10.18359/prole.5581.

The duration of legal proceedings has been controversial from the legal point of view and its impact on society. It is not enough for the State to offer the possibility of accessing the judiciary. There is an urgent need for justice to be prompt and of quality; that is, the unjustified delay of procedures should not permeate its effectiveness. This article shows how technology and procedural rules guaranteeing the reasonable duration of proceedings are vital to the due process of law. It also seeks to demonstrate how the COVID-19 pandemic has been a significant opportunity to take giant steps towards court digitization and could be the beginning of a substantial change in the administration of justice, of which legal science and the community are willing to take advantage.

Keywords : legal science and celerity; reasonable duration; legal proceedings; technologies.
