Abstract

Security forces in democratic countries must have legality and constitutional foundations to deploy and legitimize their actions in the use of force. Therefore, the concept of security must permanently integrate political institutions (organic part) and the rights of the civilian population (dogmatic part). Using a research method built on doctrine, theory, laws, and case law, we work on the hypothesis that the concept of security involves the powers of political institutions and the inherent rights of people as the basis of security and legitimate action of military, police, intelligence and investigative institutions. Due to a one-to-one relationship between the organic and dogmatic parts of the Constitution, we determined that a legal basis is created through constitutional supremacy so that the armed forces and public forces can act legitimately when necessary.
