These lines expose the presentation of the factual defect in the trial of the crime of homicide of a protected person in the Colombian legal system. The phenomenon is approached utilizing a case study after an exposition of the current methods on the appreciation of the evidence in the criminal process and through the jurisprudential examination related to the configuration of material or substantive, procedural, and factual defects. All these elements allow for the recognition of the evidentiary evidence in the object of study and the analysis of the judge's grounds in making his decision based on the legal and evidentiary aspects.
