Abstract

The result reached in this research is that the system of criminal responsibility for adolescents is established and directed on essentially pedagogical processes, differentiated and of reconstruction of the social fabric, responding, first of all, to the principle of the best interest of minors, which places them within a particularly vulnerable population, of special protection by the Colombian State, society and the families of these adolescents in conflict with criminal law. The main objective of this research has to do with the determination of the most suitable tools or solutions for Colombia to comply, both from a substantive and procedural point of view, with the whole range of principles that, from the international sphere, have made it possible to establish differentiated procedures for adolescents in such a way that their human rights are guaranteed. Therefore, the methodology of this research is of a legal and social nature, and its purpose is based on the search for solutions or instruments related to that which affect the human rights of adolescent offenders. In this sense, the scope of this study is explanatory, as it aims to describe, relate and reflect on the juvenile penal system in Colombia and its impact on society and the family.
