Abstract

GUERRERO, Víctor. From traditional legal thinking to classical legal thinking: a localized case study. Prolegómenos [online]. 2022, vol.25, n.50, pp.165-185.  Epub Mar 24, 2023. ISSN 0121-182X.  https://doi.org/10.18359/prole.6268.

This article analyzes the transformations in legal thinking in the Nariño (Colombia) department during the second third of the twentieth century. It is argued that, during this period, legal thought in Nariño transformed the canons of traditional legal thought to those of classical legal view. The article analyzes Nariño's legal thought transformations in three scenarios: theoretical-legal or doctrinal, judicial or practice of law, and curricular or teaching of law. The research is developed under a qualitative paradigm, has a historical hermeneutic approach, and its level of depth is comprehensive. Specifically, the study adopts the critical theoretical-legal approach to the history of ideas and takes up the historiographic approach to the cultural history of ideas. The privileged research sources are doctrinal products of the time (treatises and theses), law teaching curricula, and judicial journals.

Keywords : history of legal thought; historiography; legal theory; classical legal thought; traditional legal thought.
