The categorization of human rights into different generations has challenged their characteristic of indivisibility, particularly since the 1991 Constitution introduces a differentiation between those deemed fundamental and those that are not. This has led to the implementation of various means of protection. In response to this challenge, theories have emerged regarding conceptualization and fundamentality. The article attempts to address this issue through the theories of the mutation of rights and anthropocentrism, providing a review of the content or essential nucleus of the right in question.
