This article analyzes the nature, scope, challenges and promises of aspirational constitutionalism in Latin America. The text is organized into two parts. The first relates to some features of constitutionalism aspirational and analyzes the criticism that is often the subject this type of constitutionalism. The second part focuses on the tension inherent in the constitution between the legal and aspirational politics and from then presents and analyzes a typology of constitutional cases possible for Latin America.
