Abstract

AGUILERA PENA, Mario. REFOUND NATION: FORGIVE POLITICAL AND COMMON CRIMINALS. anal.polit. [online]. 2012, vol.25, n.76, pp.06-40. ISSN 0121-4705.

The article highlights the existence in Colombian history of seven major events in which forgiveness is granted amnesties and pardons to political offenders but also common. Seven joints that stand in the middle of more than two hundred legal benefits granted to political offenders mostly along the history of Colombia. Seven joints that broke the constitutional mandates of not granting such benefits to simple common criminals and political offenders who have committed heinous crimes. This trend is associated singular constitutional changes, to the idea of -social and political transformations intended to refound the nation again. To those pardons were reached in two ways: The issuance of clear rules in this regard, or by calling the benefits by another name or twisting the meaning of the rules. At a time when we talk about the end of the conflict is important to ask whether we are repeating history, regardless of the lessons she has left us.
