It analyzes the legal recognition of the violent situation in Colombia under the name of internal armed conflict, through the presidential address May 14, 2011, as part of the controversy by the 1448 Act. The analysis is focused on the operation of the logic of Juan Manuel Santos argument in favor of such recognition from the French perspective of rhetorical argument. In conclusion, it is argued that the treatment of controversial issues under legalization policies and consensus ideal, aggravate the radicalization of the opposing positions, and thus the polarization of public opinion, not an acceptance of difference coexistence through dissent, but the cancellation (discursive sometimes violent and brutal in others) the Other as a social subject.
