This article aims to develop a reflection on the guarantees of fundamental rights and human rights, analyzed from the perspective of the context of prison systems in Colombian human rights where conceptual aspects of protection and restriction of freedom are analyzed and some guaranties’ practices, emphasizing the social complexity of the guarantee of fundamental rights and contexts of human right prison systems , because the analysis of its importance , nature, foundation , function, class , will be linked to a clear vision of their purpose and practical application in the legal life from the practice of law and socio- legal arguments of human rights and re-socialization systems. Consequently, we understand the precautionary measures as guarantees from instrumental purpose in the course of court time. Its importance in the action are filing identified as ineffective to fulfill the function entrusted to him by the rule of law, taking into account the need to end the conflicts between citizens. Thus we need to establish the necessary legal nature, class, scope and handling of security measures to deprivation of liberty, citizenship and legal responsibility for observing the parties involved.
