The article reviews the relationship between constitutionalism, political transition and transitional justice seeking to explore the possibilities provided by the Colombian Constitution in the context of the political transition required under the peace accords with the Revolutionary Armed Forces of Colombia (FARC) and possibly other armed actors. In conjunction with the foregoing a conceptual characterization of the political transition and of its particular characteristics in the context of the Colombian process is carried out. This reflection is reviewed on the basis of the current constitutional framework and its prospects are evaluated within the context of negotiation as an element that favors the peace process.
