URDANETA, Juan Sebastián. INSURGENT JUSTICE DURING NEGOTIATIONS: FUNCTIONALITY AND CHALLENGES OF THE POST-ACCORD PERIOD. anal.polit. [online]. 2017, vol.30, n.90, pp.25-44. ISSN 0121-4705. https://doi.org/10.15446/anpol.v30n90.68303.
The article seeks to explore how justice was administered by the “Revolutionary Armed Forces of Colombia, Peoples Army” (FARC-EP using its Spanish acronym) during the final stages of negotiations between the government and the insurgency in certain regions of the Colombian southeast. The goal, by means of a specific case study and use of structured and semi-structured interviews, is to challenge the theses that law was nonexistent in the country’s peripheries through description of forms of justice operating in such territories. Using legal pluralism as the theoretical predicate, the norms, bureaucracy and sanctions that enabled insurgency organized social relationships, always in conjunction with Communal Action Boards, are examined. Based on the foregoing, comparisons and contrasts with state action are proposed, in the context of the challenges posed during the post-accord period.
