Abstract

This article intends to analyze the integral reparation to the victims in the Final Agreement for the Termination of the Conflict with the FARC, which was signed at the end of 2016. It is also registered in the model of Transitional Justice proposed by the Special Justice of Paz -JEP-, created by the Legislative Act 01 of 2017 from the peace agreements of Havana, signed between the Colombian State of the FARC, known as the Final Agreement, aimed at the search of the truth, to satisfy the rights of the victims, to punish those responsible for crimes under the jurisdiction of the International Criminal Court and serious crimes under the jurisdiction of the Inter-American Court of Human Rights.

Likewise, Law 1820 of 2016 is analyzed, especially the issue of general amnesties, as these are prohibited by the standards of the Inter-American Court and the International Criminal Court. Questions are presented to Law 1820 and to the sentence C-007 of 2018 that revises the constitutionality of said Law, especially the main “inconveniences so that there is an integral reparation to the victims of the armed conflict”, which are derived from the Articles 7, 41 and 42 of this Law.
