Abstract

The knowledge was crucial in hiring experts to conduct the first works the nascent Colombia. With training abroad a few engineers in XIX century and the dawn of the XX century and the birth of the first faculties of engineering, knowledge began to spread, and the knowledge, ethics and quality was the obvious elements for their selection. At the required works for the development of the country increasingly in size and complexity, was create the first engineering consulting firms, and promoted its association with international consultants to enable them to execute, transfer and assimilation experience, knowledge and training of professionals. The selection of consultants remains until the 80, knowledge-based and the quality and price negotiated more non selection factor. The relationship Client-Consultant was based on mutual confidence. With overcrowding of training and specialization of engineers supply began to exceed demand. It multiplied companies and contracting entities were given multiple choices. The competition resulted in the need for state contract regulations. Successive laws and regulations were issued, reaching Act 80 of 1993 in which the price was introduced as a decisive factor in selection. A big mistake was made by the State enabling price competition without introducing mechanisms to ensure product quality. The lack of planning led to hire long-term projects in improvised form, disregarding the essential pre-investment studies. It led to the informal consultation, unfair competition from universities and the deterioration of wages of professionals. The possibility of granting and obtaining contracts without requiring most deserving, encouraged corruption, all of which resulted in poor work, and in the clear weakening of the business of consulting. The litigation and claims that flooded the courts are the result of this misguided policy. Alarmed multilateral agencies and the Government with the results, promoting changes to laws on hiring, approving the 1150 Act, 2007 and issued the decree No. 66 of 2008, legislation that not allowed to correct the deficiencies of the Act 80 and that must be reformed immediately.
