Abstract

This article offers an overview of the current status of the criminal matter in order to show some elements that may explain why raises again the possibility of criminalizing criticism. Assuming that the problem of "punitability" is not only an institutional matter, the article emits some questions about the role of society in this atmosphere of punitive optimism and expansion of Criminal Law.
