This article is based on the research of how Constant and Tocqueville correlate Democracy and Rule of Law or with a form of political organization based on the division of powers and on legality; when the said correlation is not brought about in a reasonable way then Democracy turns into its opposites: tyranny, dictatorship and despotism.

Keywords : Benjamin Constant; Alexis de Tocqueville; Democracy; Despotism; Dictatorship; Freedom.
