Abstract

SARRABAYROUSE OLIVEIRA, María José. Distortion of Categories: Judicial Independence and Access to Justice. The Transformational Process of Democratizing the Justice System in Argentina. colomb.int. [online]. 2015, n.84, pp.139-159. ISSN 0121-5612.  https://doi.org/10.7440/colombiaint84.2015.05.

This article will attempt to discuss questions linked to the so-called 'Democratization of the Justice System' in Argentina, which was due to take place in 2013. The problems discussed here are closely linked to the traditional operations of the courts. At the risk of objectifying concepts and categories, converting clear debates into axioms to be fulfilled, this work will reflect on two main themes: i) the problem of 'judicial independence' and the way in which this is understood and achieved, and how the 'judicial family' fits into the equation, and ii) the discussion on 'access to justice'. Finally, by way of conclusion, an attempt will be made to discuss the possibilities and challenges associated with considering judicial reforms through discussions with outside parties.

Keywords : Argentinean justice system; judicial independence; judicial family; access to justice; judicial reforms.
