When the dissolution of the relationship between the Spanish monarchy and its former Hispano-American colonies took place, new problems arose for the actors who determined the political organization of the new states. During the first part of the 19th century, and embedded in a spirit of renovation, the governing elites established new forms of institutional organization and authority imposition. However, these changes were introduced in societies that responded to cultural patterns which belonged to the ancient regime. In this paper, we will address this contradiction in connection to the organization of justice, considered as a key element in the passage from the ancient regime to the liberal and modern republic. We will analyse the justice of the Rioplatense province of Mendoza when the provinces of Río de la Plata were arranged in a confederation; thus, each provincial state exercised sovereignty independently.
