Abstract

OSORIO MORENO, César Alejandro. The evolution of penal protection of Copy Rights in Colombia. Rev. Derecho [online]. 2010, n.34, pp.147-176. ISSN 0121-8697.

This reflection article is part of an investigation conducted to determine the legitimacy of the moral protection of copyright in the Colombian legislation from a compared perspective with the Spanish law, but this discussion will deal only with the evolution of the criminal protection of copyrights in Colombia. It is a basic research applied under a qualitative methodological approach. Information was consulted and classified and then it was systematized and analyzed according to a critical perspective. Secondary sources were used in the historical overview of the laws that protect copyrights to demostrate that the protection is provided almost always by civilian law, that as offense it is rarely studied by the national doctrine. It is a criminal type forwarding to other regulations (civil) in order to define their application. It is a "white criminal type" that violates many of the safeguards of criminal liberal law, minimally as the principle of legality now that the copyright has a particular significance in the socio-economic criminal law by the excess of piracy in the modern world.

Keywords : Criminal protection; copyright; criminal safeguards; legality principle; socio-economic criminal law.
