This document is a reflection paper which discusses some conceptual and factual elements regarding the feasibility of establishing a general clause of attraction to arbitration justice in the private contractual system in Colombia. In particular, it shows how the deviation of the case law on the arbitrability of the decisions of assembly (in traditional societies and the SAS) is a step forward or step towards the generalization of arbitral justice.
