Abstract

GUEVARA, Carolina. Judicial independence: The case of the Colombian Supreme Court. Rev. Derecho [online]. 2011, n.35, pp.145-179. ISSN 0121-8697.

This article shows the importance of legal tradition and the organization of the judicial system: recruitment, warranties of immobility, budget and salary requirements may be greater or lessindependent of the judiciary. Similarly, it shows how studies on judicial independence that have been made in Colombia have favored the Constitutional Court, and to a lesser extent the Supreme Court. Finally, the study concludes that despite a number of regulatory safeguards aimed at preserving the independence of judges in Colombia, this is very variable, and depends ultimately on the will of the executive.
