The present work studies the figure of the patrimonial responsibility of the Legislative State. It checks its principal precedents attending to the Spanish and French jurisprudence. It distinguishes its two principal types or hypothesis and analyzes critically the most spread arguments that reject its recognition and application. It proposes that those skeptical arguments towards the responsibility of the legislative State concern in a diverse way its two branches.
