Abstract

CARPINTERO BENITEZ, Francisco. The irrational derivation of the theories of justice. Rev. Derecho [online]. 2015, n.43, pp.1-35. ISSN 0121-8697.  https://doi.org/10.l4482/dere.43.7474.

The author refers to 'old-mechanicals' molds (moldes veteromecánicos) on which science has been built from the Enlightenment until today, including the humanistic sciences. From the mechanical view not only was a Deus ex machina but also an Homo extra machinam: no place for humans in the Newtonian world. This old scientific paradigm has changed today with the contributions of twentieth century physics, but in place of practical philosophy, that old materialism is unabashedly continuing.

Keywords : Empiricism; person in the right or legal person; legal positivism; current scientific paradigm; legal ontology; theories of justice.
