Abstract

RUA DELGADO, Carlos Felipe. The moments of transitional justice in Colombia. Rev. Derecho [online]. 2015, n.43, pp.71-109. ISSN 0121-8697.  https://doi.org/10.14482/dere.43.6270.

The process of adoption of transitional justice in Colombia may be analyzed from three very marked times: the first one, schizophrenia to reason, refers to convulsive relationships between paramilitaries and some sectors of the political and military establishment, which generated a schizophrenic state which wanted to return to reason with the adoption of transitional justice norms from Justice and Peace Law; the second moment corresponds to recognition of the existence of an internal armed conflict by the Colombian legislator with the Law 1448 of 2011, which implied a new meaning to the victim's role and the third moment refers to constitutionalization of transitional justice with legal framework for peace, which gives constitutional category to use prioritization and selection criteria as prosecuting strategy and introduce extrajudicial mechanisms that seek to meet international standards.

Keywords : transitional justice; justice and peace; victims; legal framework for peace.
