Abstract

This paper describes the rulings issued by Colombian's Constitutional Court on the rights of same-sex couples. The methodology used is based on descriptive research, including the review of documents, bibliographic sources, and case law. Results show how same-sex couples in Colombia have in recent years, through constitutional actions brought by them, extended recognition of their citizenship and acceptance of their diversity. The rulings on these constitutional actions have recognized their rights to be equal to those of heterosexual couples to create a family protected by the Constitution. We conclude by stating which rights have been granted and by presenting a body of case law that reflects the change in the Constitutional Court's rulings on this issue, which has in turn generated changes in different areas of law additionally, the influence of neo-constitutionalism in the court rulings that grant such rights is examined.
