From Spanish legal system's analytical perspective, this paper aim to explain that the damage caused in the legitimate exercise of the right to strike are not repairable as a tort. To reach this purpose, so-called lawful damages, and damages on the right to strike will be addressed, and the event in which they admit an indemnity for that purpose.
