Jürgen Habermas has argued that the political concept of human rights derives in the loss of the explosive political force of this doctrine. This paper gives account of such criticism making use of the tools available in the philosophy of law. Specifically, from the idea of rights in general and what this paper will label its positional and descriptive dimensions.
