Abstract

ZAPATA-FLOREZ, JONATHAN. Scope and effects of nuiiity in contractual networking in colombian private law. Rev. Derecho [online]. 2019, n.52, pp.88-115. ISSN 0121-8697.

This article discusses the effect of nullity in a contract that is linked to others in a contractual networking. It begins by characterizing the contractual network to continue with the regime of nullities in the Colombian private law system and ends by analyzing and proposing the effect that the nullity displays on a complex business system (contractual networking) when one of the part contracts is invalidated. The aim is to systematize the criteria for the existence of contractual networking and to expose the possible effects on the validity of contracts, since this is the most problematic scenario in light of the principle of legality. It is concluded that the nullity that affects a contract linked to a contractual network, can only extend its effect when it undermine the contractual networking cause. This writing is the product of a qualitative research with a dogmatic approach with a specialized documentary technique.

Keywords : Supra-contractual cause; contractual networking; nullity in contractual networking.
