Abstract

The article develops the revision standard of indirect expropriation applicable to the Eco Oro vs. Colombia case, whose pretentions are supported on the Free Trade Agreement FTA between Canada and Colombia (2008), investment chapter. The case shows how complex it could be to harmonize the clash between the environment protection, specially, paramo ecosystems, in a country that owns the wealthiest paramus in the world, and the respect of the economic rights granted to investors that started a mining project with the authorization of the host state. Finally, the article suggests exploring the due diligence's limits and concurrent negligence in cases where the indirect expropriation emerges as a consequence of the environment protection.
