The purpose of this article is to analyze how the fundamental right to personal freedom, declared in the Political Constitution of 1991, is limited based on the constitutional and legal mechanisms provided for it, such as capture and apprehension, as well as the different types preventive detention. In this order of ideas, it is pertinent to carry out an analysis that seeks to address the normative basis of these mechanisms, in such a way that it is possible to identify how they affect the limitation of the aforementioned right.
